BaFin supervisory activities under the EU Green Bond Regulation

BaFin informs about its supervisory activities under the EU Green Bond Regulation in force since December 21, 2024, which implements a voluntary standard for green bonds with special ecological sustainability criteria.



BaFin monitors whether issuers of EU Green Bonds fulfill their reporting and information obligations, which include a securities prospectus, an information sheet before issuance, annual allocation reports, and a final impact report.


The examination standard is based on securities prospectus review and encompasses completeness, comprehensibility, and consistency of information, with BaFin deciding on a case-by-case basis which emissions to examine and generally conducting a review for each issuer's first-time emission.


For submitting notifications according to Article 15 paragraph 4 of the EUGB Regulation, the MVP portal with the provided BaFin form must be used exclusively. In case of violations, BaFin can require issuers to make improvements or impose sanctions, with the legal basis being the correspondingly amended version of the Securities Prospectus Act.
